1. Acceptance of Terms

Welcome to Skeleton Harbor. These Terms set the rules of the pier—what you can expect from us, and what we expect from you—across the website and our Discord app.

By using our Services, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Services.

2. Eligibility & Accounts

Our community thrives when accounts are real, secure, and responsibly used. Keep your details accurate and your credentials safe.

• Minimum Age: You must be at least 13 years old; if under your local age of majority, you need parental/guardian consent.
• Registration: Provide accurate information and keep it current.
• Security: You’re responsible for all activity under your account and for safeguarding your login.
• Discord Login: If you authenticate via Discord, you authorize us to receive permitted account data per our Privacy Policy.

3. Subscriptions, Billing & Cancellations

Subscriptions help keep the lighthouse lit—unlocking features on the site and Discord. We aim for clear pricing and easy cancellation.

• Plans: Free and paid tiers may be available; details shown at checkout or in your account.
• Billing: Payments are processed by third parties (e.g., Stripe); we don’t store full card numbers.
• Renewal: Subscriptions auto-renew unless cancelled before the billing cycle ends.
• Cancellation: Cancel anytime; access continues until the end of the current term.
• Refunds: Unless required by law or stated otherwise, fees are non-refundable.
• Changes: We may adjust pricing/features prospectively with reasonable notice.
• Taxes: You’re responsible for applicable taxes/fees.

4. Discord App & OAuth

Our Discord app connects your harbor account with your Discord identity to unlock server features you choose to enable.

• Permissions: The app may request limited permissions to function (e.g., profile, server membership you authorize).
• Conduct: You must follow Discord’s Terms/Guidelines and our Community Guidelines.
• Revocation: You can revoke OAuth access in Discord settings; related features may stop working.

5. User Content & Community Guidelines

Share, discuss, and create—but do so respectfully. We moderate to keep the community welcoming and lawful.

• Your Responsibility: You own your content and must have rights to share it.
• License to Us: You grant us a non-exclusive, worldwide, royalty-free license to host, display, and adapt your content as needed to operate/improve the Services.
• Ground Rules: No illegal content, harassment, hate, threats, doxxing, malware, spam, scams, or IP infringement.
• Moderation: We may remove content, limit features, or suspend accounts that violate these Terms or the law.

6. Intellectual Property & Licenses

Our writing, artwork, code, and brand elements are protected. Enjoy them for personal use—don’t copy or republish without permission.

• Our Content: Owned by/ licensed to Fatal Glitch Studios LLC and protected by IP laws.
• Your License: Limited, non-transferable, revocable license for personal, non-commercial use.
• Trademarks: “Skeleton Harbor” and related marks may not be used without written consent.

7. Prohibited Uses

Keep the waters safe. Don’t misuse the Services or try to break, scrape, or exploit them.

• Violating laws, regulations, or third-party rights
• Reverse-engineering, scraping, or automated extraction without consent
• Interfering with security, integrity, or performance (e.g., DDoS, malware)
• Accessing non-public areas or others’ accounts
• Impersonation, fraud, or deceptive conduct
• Uploading/linking harmful or illegal content

8. Privacy

Your data is handled per our Privacy Policy. We collect only what we need to run features you choose and keep things secure.

9. Third-Party Services & Links

We integrate with services like Discord, Stripe, or YouTube. Their docks, their rules—please review their terms and policies.

Your use of third-party services is governed by those services’ terms.

10. Copyright/DMCA

If you believe something here infringes your copyright, tell us and we’ll review quickly.

Your notice should include: (1) contact info, (2) description of the work, (3) URL of the material, (4) good-faith statement of unauthorized use, (5) statement under penalty of perjury, and (6) your signature.

11. Disclaimers

We do our best to keep everything running smoothly, but no site or app is perfect—and ours is provided as-is.

• As-Is/As-Available: No warranties, express or implied.
• No Advice: Content is informational/entertainment only, not professional advice.
• Availability: We don’t guarantee uninterrupted or error-free operation.

12. Limitation of Liability

We limit our legal exposure to what’s reasonable for a creative project like this. Please use the Services responsibly.

To the fullest extent permitted by law, we’re not liable for indirect/special/consequential damages or lost profits/data/goodwill. Our total liability is capped at what you paid (if any) in the past 12 months.

13. Indemnification

If your actions cause claims against Skeleton Harbor, you agree to help cover the resulting costs.

You agree to defend, indemnify, and hold harmless Skeleton Harbor/Fatal Glitch Studios LLC and affiliates from claims arising from your content, misuse, or violation of these Terms.

14. Suspension & Termination

We rarely ban, but we will to protect users and the platform. Some obligations continue even after access ends.

• We may suspend/terminate access with or without notice for violations or risks.
• Upon termination, your license ends. Provisions on IP, disclaimers, liability limits, indemnity, and governing law survive.

15. Governing Law & Disputes

These Terms and any dispute arising out of or relating to your use of Skeleton Harbor are governed by the laws of the United States and the State of New Mexico, without regard to conflict-of-law principles.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction and venue.

Before initiating formal legal action, you agree to contact us at privacy@skeletonharbor.com to attempt good-faith resolution. This informal step does not limit our right to seek injunctive relief or enforce our intellectual property rights immediately where necessary.

Any claim must be filed within one (1) year of the event giving rise to it, or it is permanently barred, unless prohibited by law.

16. Changes to These Terms

We may update these Terms as our harbor grows. When we do, we’ll change the date and notify you if the changes are material.

Continuing to use the Services after the effective date means you accept the updated Terms.
